1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and okataoo.io ("okataoo," "we," "us"). By creating an account, connecting a Garmin device, or otherwise using our website or application (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, in which case "you" refers to both you and the organization.

3. Your account

You are responsible for the accuracy of the information you provide.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Notify us immediately at info@okatoo.io if you suspect unauthorized access.

4. The service & medical disclaimer

okataoo.io is a consumer wellness product. It reads health and activity data you authorize us to access through Garmin's Health API and presents insights, trends, and AI-generated recommendations.

Not medical advice. okataoo.io is not a medical device. Our content, AI recommendations, and any feature of the Service are provided for general informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or condition, and are not a substitute for professional medical advice. Always consult a qualified healthcare provider before making health, training, or nutrition decisions. Never disregard professional medical advice or delay seeking it because of something you read or saw on okataoo.io.

4.1 AI outputs

AI-generated insights can be inaccurate or incomplete. You are responsible for evaluating their usefulness for you. Do not rely on okataoo.io for emergency, urgent, or clinical decision-making. If you are experiencing a medical emergency, call your local emergency number.

5. Garmin integration

You may optionally connect a Garmin account to the Service. By doing so you authorize Garmin to transmit health and activity data to us in accordance with the OAuth scopes you approve.
Your use of Garmin devices, accounts, and services is governed by Garmin's own terms and privacy policies, which are separate from these Terms.
okataoo.io is an independent third party and is not affiliated with, endorsed by, or sponsored by Garmin Ltd. or its subsidiaries.
You may revoke our access at any time via the Service settings or at Garmin Connect.
We rely on Garmin for the completeness and accuracy of the data. We make no guarantees about data availability or correctness.

6. Acceptable use

You agree not to:

Use the Service in a way that violates any applicable law or regulation;
Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
Interfere with or disrupt the Service, its servers, or networks;
Use the Service to build a competing product or to scrape, harvest, or mirror its content;
Upload or transmit content that infringes on others' rights, is defamatory, or contains malware;
Access another person's data without authorization;
Use the Service to provide medical or clinical services to third parties without a separate written agreement with us.

7. Intellectual property

The Service and all content we provide — including text, graphics, logos, software, and designs (excluding your content and Garmin-sourced data) — is owned by okataoo.io or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use.

8. User content

You retain all rights to the content you submit, including profile details, notes, photos, and health data you import. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content solely to operate the Service for you and, in aggregated/de-identified form, to improve the Service. You are responsible for ensuring you have the right to share any content you submit.

9. Subscriptions and fees

Some features may be offered on a subscription basis. Pricing and terms will be shown before purchase.
Subscriptions renew automatically until canceled. You can cancel at any time in your account settings.
Except where required by law, fees paid are non-refundable.
We may change prices with at least 30 days' notice; changes apply to the next billing period.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive (such as IP, disclaimers, limitation of liability, and dispute resolution) will survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR RELIABLE. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OKATAOO.IO, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless okataoo.io from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You and okataoo.io agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware, subject to any mandatory consumer-protection rights in your jurisdiction. Where available, we encourage you to contact us first at info@okatoo.io so we can try to resolve any issue informally.

15. Changes

We may update these Terms from time to time. When we make material changes, we will notify you by email or by a notice inside the Service before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, please stop using the Service.
